These Terms of Service (“Terms”) govern access to and use of the BigLoads Merch website and online store (the “Store”), operated by BigLoads Merch (“BigLoads Merch,” “we,” “us,” or “our”). The Store is powered by Shopify Inc. (“Shopify”).

By accessing or using the Store, including browsing or purchasing merchandise, individuals agree to be bound by these Terms and all applicable laws and regulations. If an individual does not agree to these Terms, they must not access or use the Store.

1. Eligibility

The Store is intended for individuals who are at least the age of majority in their jurisdiction. By using the Store, individuals represent that they meet this requirement.

2. Scope of Services

The Store sells branded merchandise only. The Store is separate from the BigLoads trailer rental marketplace, and no purchases made through the Store grant access to marketplace services, memberships, listings, or rentals unless expressly stated in writing.

3. Account Information

Creating an account is optional. If an account is created, individuals agree to provide accurate, current, and complete information and to maintain the security of their account credentials. BigLoads Merch is not responsible for unauthorized access resulting from failure to safeguard login credentials.

4. Orders and Payments

All purchases are subject to acceptance and availability.

Prices are listed in U.S. dollars unless otherwise stated
Payment processing is handled by Shopify and its third-party payment processors
BigLoads Merch does not store full payment card details

BigLoads Merch reserves the right to refuse or cancel orders, including in cases of suspected fraud, errors in pricing or availability, or violations of these Terms.

5. Shipping, Returns, and Refunds

Shipping timelines, return eligibility, and refund policies are described on the Store and incorporated into these Terms by reference. BigLoads Merch reserves the right to modify fulfillment partners and shipping methods.

6. Promotional Communications and Marketing

By using the Store or providing contact information, individuals may receive transactional or marketing communications. Marketing communications may be opted out of at any time using provided unsubscribe mechanisms. Transactional communications related to orders may still be sent.

7. Intellectual Property

All content on the Store, including logos, trademarks, designs, product images, graphics, text, and software, is owned by or licensed to BigLoads Merch and protected by intellectual property laws.

No content may be copied, reproduced, distributed, modified, or used for commercial purposes without prior written consent.

8. User Conduct

Individuals agree not to:

Use the Store for unlawful or fraudulent purposes
Attempt to interfere with the Store’s security or functionality
Submit false, misleading, or abusive information
Violate any applicable laws or regulations

BigLoads Merch reserves the right to restrict or terminate access for violations.

9. Third-Party Services and Links

The Store may include links to third-party websites or services. BigLoads Merch does not control and is not responsible for third-party content, policies, or practices.

10. Disclaimers

The Store and all merchandise are provided “as is” and “as available.”

To the fullest extent permitted by law, BigLoads Merch disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, BigLoads Merch shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to use of the Store or purchase of merchandise.

Total liability, if any, shall not exceed the amount paid for the applicable order.

12. Indemnification

Individuals agree to indemnify and hold harmless BigLoads Merch, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from use of the Store, violation of these Terms, or infringement of third-party rights.

13. Termination

BigLoads Merch may suspend or terminate access to the Store at any time, with or without notice, for any reason, including violation of these Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

15. Dispute Resolution & Arbitration

At BigLoads Merch’s discretion, disputes may be resolved through binding arbitration rather than court litigation, except where prohibited by law. Arbitration shall be conducted in Texas.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. Changes to These Terms

BigLoads Merch may update these Terms at any time. Updated Terms will be posted to the Store with a revised “Last Updated” date. Continued use of the Store constitutes acceptance of the revised Terms.
